While working under fire Sacks’ officer, Lieutenant Stewart, was shot, Sacks and some of his friends attempted to carry Lt. Stewart back to safety. While doing this a shell went off nearby and Sacks was fatally injured. A friend later reported to the family that they sat with him and comforted him until he passed away which was very shortly after the explosion.

Sacks’ friends reported they had made sure he was buried in a marked grave in a place he could be located near to a farm. Unsure of how to mark his grave, they placed a cross and made an attempt to mark it with a Magen David, later asking a Rabbi to tend the grave and make sure it had the correct engraving which was reported to have been done.

Several of Sacks’ friends witnessed his death and gave reports and descriptions to confirm his passing away. Due to some discrepancies in their descriptions, for example his height being listed as 5”9 rather than his actual 5”11 and him being described as from Brisbane rather than from Perth Sacks’ father wrote to the War Office hopeful that it was not in fact his son who had been killed. He appealed to them several times to question if there was a chance that it wasn’t his son but it was confirmed that Sacks’ had indeed been killed in action trying to rescue his officer in June 1917.
